Terms of Use
1. Agreement to These Terms
These Terms of Use ("Terms") govern your use of the BandFrame mobile application and website (together, the "Service"), operated by BandFrame ("we", "our", or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Your Account
- You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account.
- You must be at least 13 years old to use BandFrame.
- We may suspend or terminate accounts that violate these Terms.
3. Your Content
You own everything you create in BandFrame. Your tabs, lyrics, recordings, imported audio, and arrangements are yours. We claim no ownership over your music.
By using the Service, you grant us a limited license to store, process, and transmit your content solely to operate the Service — for example, syncing your recordings to the cloud, streaming them to your devices, and sharing them with project members you invite.
When you share a project with other users, you grant those users access to view (and where you permit, edit) the content in that project. You are responsible for who you invite.
You agree not to upload content that you do not have rights to, that infringes any third party's intellectual property, or that is unlawful.
4. Subscriptions
BandFrame offers an optional auto-renewing subscription, BandFrame Pro:
- Monthly: $3.99 per month
- Annual: $29.99 per year
- New subscribers may be eligible for a 7-day free trial. If you do not cancel before the trial ends, your subscription begins automatically.
Payment is charged to your app store account (Apple ID) at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your app store account settings at any time; cancellation takes effect at the end of the current billing period. Amounts already charged are non-refundable except as required by law or by your app store's refund policies — refund requests for App Store purchases are handled by Apple.
Prices may change; we will provide notice of price changes as required by the app store, and changes will apply no earlier than your next billing period.
5. Free Tier Limits
The free tier includes limits (such as a cap on total recordings and audio library imports) that we may adjust over time. Content you created above a limit is never deleted by a plan change — limits only restrict creating new content.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the Service, including by reverse engineering, scraping, or overloading our infrastructure
- Upload malicious code or content
- Harass or abuse other users
7. Intellectual Property
The Service itself — including the app, website, design, and branding — is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. This section does not affect your ownership of your own content (see Section 3).
8. Copyright and DMCA Policy
We respect the intellectual property rights of others and expect our users to do the same. As described in Section 3, you may only upload content you have the rights to use. We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act ("DMCA").
If you believe content on the Service infringes a copyright you own or control, send a written notice to our designated agent at bandframeapp@gmail.com with the subject line "DMCA Notice," including:
- Your physical or electronic signature;
- Identification of the copyrighted work you claim has been infringed;
- Identification of the material you claim is infringing and enough information for us to locate it (for example, the project or file and the account it was shared from);
- Your name, address, and email address so we can contact you;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
When we receive a valid notice, we will remove or disable access to the material and make a reasonable effort to notify the user who posted it.
Counter-notice. If you believe your content was removed by mistake or misidentification, you may send a counter-notice to the same address including your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, and your name, address, and consent to the jurisdiction of the federal court for your judicial district. We may restore the material if the original complainant does not seek a court order within the time the DMCA allows.
Repeat infringers. We will, in appropriate circumstances, suspend or terminate the accounts of users who repeatedly infringe the copyrights of others.
9. Service Availability and Changes
We work to keep the Service available and your data safe, but the Service is provided "as is" and "as available." We may modify, suspend, or discontinue features at any time. We recommend keeping local copies of recordings that are important to you.
10. Disclaimer of Warranties
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data loss will never occur.
11. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the twelve months before the claim arose (or $50 if you have paid nothing).
12. Termination
You may stop using the Service and delete your account at any time from within the app (Profile → Delete Account). We may suspend or terminate your access if you materially violate these Terms. Sections 3 (as to past grants), 8, 10, 11, and 13 survive termination.
13. Governing Law
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Maryland, and you consent to their jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
